What SizeUp is
SizeUp is software. It lets a homeowner measure work on her phone, works out an estimate from the business’s own prices, and carries the job through to a confirmed price after a site measure.
SizeUp does not do building work, does not employ tradespeople, and is not a party to the contract between a homeowner and a business. The business holds its own licence and insurance and is responsible for the work, its price and its workmanship.
An estimate is an estimate
An estimate produced from a homeowner’s own measurements is an estimate, not a quote and not a fixed price. It is shown with a range for that reason.
The price becomes firm when the business has measured on site and the homeowner has approved the confirmed price. Nothing is ordered before that approval.
Measurements taken through a phone can be wrong. Neither SizeUp nor the business is bound by a price produced from a measurement that turns out to be inaccurate; what the business stands behind is the confirmed price.
For homeowners
Measure honestly and describe the work as it is. An estimate worked out from a wrong measurement wastes your time more than anybody else’s.
Your measurements and photos stay yours. You can send them to more than one business, and you can ask for them to be deleted.
Accepting an estimate books a site measure. It does not commit you to the work. Approving the confirmed price does, and from that point the business may order materials against it.
If something is wrong with the work, the business is the one to take it up with, and Australian Consumer Law applies to what it does for you.
For businesses
You are responsible for your prices. SizeUp works out an estimate from the schedule you enter, and a mistake in that schedule becomes a mistake in an estimate. Check what goes out.
You are responsible for the licences, insurance and written contracts your work needs. In New South Wales, residential building work over $5,000 including GST needs a written contract, and a deposit may not be more than 10% of the contract price. SizeUp does not provide that contract.
You decide what to do with your customers’ details once you have them, and you are responsible for that under your own privacy obligations.
Subscriptions are monthly and can be cancelled at any time, effective at the end of the period paid for. A free trial needs no card. Prices are in Australian dollars and include GST where it applies.
Do not use SizeUp to send messages to people who have not asked to hear from you. The messages SizeUp sends on your behalf are the ones a request, an estimate or a job sets off.
Availability and support
SizeUp aims to be available at all times but does not promise it. Maintenance is kept out of business hours where possible.
Support is by email from 8 am to 6 pm Sydney time on weekdays. The Business and Team plans get a first reply within two business hours; Solo gets one business day.
Liability
Nothing in these terms excludes a right you have under Australian Consumer Law.
Beyond those rights, SizeUp’s liability for anything arising out of the use of the software is limited to the subscription fees paid in the twelve months before the claim. SizeUp is not liable for work carried out by a business, for a price a business set, or for a measurement a homeowner took.
Which law applies
These terms are governed by the law of New South Wales, Australia.
